TOLEDO, Ohio (WTVG) – A Toledo family says a city demolition project damaged their home last week and claims the city is asserting immunity from responsibility, leaving them to handle repairs on their own.
The family lives next to a demolition site on Maplewood Avenue, where crews tore down a condemned apartment building that neighbors say had been an issue for around 10 years.
Maurice Parker, whose mother owns the damaged home, said part of the demolished structure fell onto their property during the demolition.
“In the midst of that demolition, that’s when part of the structure fell on my mother’s home,” Parker said.
Parker’s mother is currently dealing with health issues. While his aunt was visiting during the demolition, they say debris hit the home, knocking a mirror off the wall and onto her head.
“She said she felt like it felt like an explosion,” Parker said.
The damage extends from the outside of the home to the interior. Parker said the demolition debris damaged the roof and gutters, and the impact shifted the foundation and cracked the walls inside the home.
“You see the cracks,” Parker said, pointing to visible damage.
The family says the city of Toledo has claimed immunity from responsibility for the damage through their conversations with city officials.
“If it was other construction, or if it was somebody else doing the project, would they be liable, would they have immunity?” Parker said.
The family says homeowners’ insurance will help cover some costs, but wants the city to better communicate with neighbors before planned demolitions.
“Let them know, an advanced warning to get them prepared if they’re not prepared for situations like this,” Parker said.
The city of Toledo said they are looking into the situation and will provide more information in the coming days.
