Board of Zoning Appeals maintains mining operation cannot continue, upholds zoning violation

TOLEDO, Ohio (WTVG) – A months-long ordeal between the Toledo City Council, South Toledo residents, and a company that was mining in a residential neighborhood is closing a chapter.

City leaders ultimately ordered the company to stop all activity on that residential property and the company fought back to continue, filing an appeal.

Rocky Ridge Development LLC’s Managing Director Ed Moore stood before the Board of Zoning Appeals Monday morning, hoping to reverse the emergency zoning violation notice outside of the mining operation in South Toledo.

Zoning leaders asked all operations to cease because the Toledo Municipal Code states that mining is not allowed on residential land.

“We ask that the notice be rescinded and set aside in its entirety for reasons I will address,” Moore said to the board during the meeting.

The board heard his case. Moore said the company stopped operating at 4004 Angola Road after the notice was posted.

Moore was fine with not mining, but wanted to continue dumping water treatment material into the hole.

Some residents living and working around the mining property have been organizing against the operation.

“I’ve been kind of heading up the coalition of South Toledo against the dumping on the property of Byrne and Airport and Angola,” Bill Hoag, one of those residents, said

Hoag and others gave testimony that they did not want this industrial project on residential land.

“It’s in direct violation of the codes, you can’t be doing that,” Hoag said.

The board agreed, with members saying the residential property was not suited for commercial activities, and they would not disagree with previous rulings.

All members voted to strike down the appeal, upholding the order that Rocky Ridge cannot operate on those South Toledo properties.

One zoning official said the next course of action for the company could be to file a special use permit to dump the drinking water treatment material.

Hoag said this fight may not be over yet.
