FOSTORIA, Ohio (WTVG) – The Seneca County Board of Health intends to deny a landfill an operating license in 2025 over alleged noncompliance and falsified records.
A statement from the agency on Friday said the board passed a resolution on Thursday to issue a notice of intent to deny WIN Waste Innovations an operating license next year.
The agency claims WIN Waste falsified inspection reports and kept an internal inspection log that noted ongoing erosion and ponding issues that were not mentioned in the documentation the facility submitted to the health board or the Ohio EPA. It went on to say that WIN Waste failed to use best practices for erosion control.
The board of health also said the company did not control odors and violated rules on restricting hydrogen sulfide emissions. Additional allegations against the company claim it did not conduct daily inspections of rail cars at the landfill for leaks or spills.
“It does not make sense to issue another operating license with conditions that won’t be followed,” Seneca County Board of Health President Dr. Clay Wolph said. “The 2023 and 2024 license conditions are more than reasonable and are necessary to safeguard our environment and residents.”
The company can request a hearing within 30 days, at which point a hearing examiner would issue a recommendation for the board to consider. The agency said if the license is denied, WIN Waste can appeal for the Environmental Review Appeals Commission.
WIN Waste can continue to operate under its 2024 license with conditions, the agency said, but the company has filed a separate case with that appeals commission to dispute the conditions.
